These General Conditions (“Terms”) govern your access to and use of the website www.serenea-cosmetics.com (the “Website”) and any orders placed through the Website.

By using the Website and/or placing an order, you agree to these Terms.

1) Definitions
Company / We / Us: Beauty 4 All Ages (B4AA BV) operating under the brand SERENEA COSMETICS.
Customer / You: any person browsing the Website and/or placing an order.
Products: cosmetic products and related items offered for sale on the Website.
Order: a purchase request submitted via the Website.
2) Scope and acceptance
2.1. These Terms apply to all use of the Website, all communications with the Company and all offers, quotations and Orders placed via the Website, unless explicitly agreed otherwise in writing.
2.2. Any of your own terms and conditions are excluded unless we expressly accept them in writing.

3) Eligibility / Professional access (if applicable)
3.1. Certain sections, pricing or services may be intended for professionals only and may require registration and/or verification.
3.2. We may refuse, suspend or terminate professional access if we reasonably suspect misuse, incorrect information, or non-compliance with these Terms.

4) Product information
4.1. We aim to describe Products as accurately as possible (including images, ingredients and usage). However, product packaging, appearance and shades may vary.
4.2. Unless mandatory law provides otherwise, minor differences do not constitute a defect or non-conformity.
4.3. Product availability is not guaranteed; we may limit quantities.

5) Prices, taxes and delivery costs
5.1. Prices are shown in EUR unless stated otherwise.
5.2. Prices include VAT where applicable, unless indicated otherwise.
5.3. Shipping/delivery fees (if any) are shown during checkout.
5.4. Promotions (including any free delivery threshold and/or free samples offers) are subject to the conditions displayed on the Website at the time of your Order and may change at any time, to the extent permitted by law.

6) Ordering process and conclusion of contract
6.1. Products displayed on the Website constitute an invitation to place an order and not a binding offer, unless stated otherwise.
6.2. A contract is formed when we confirm acceptance of your Order (e.g., via order confirmation email) and/or dispatch the Products.
6.3. We may refuse or cancel Orders (e.g., in case of suspected fraud, mispricing, stock issues, or delivery restrictions). If payment has been received, we will refund amounts paid for the cancelled items/order.

7) Payment
7.1. Payment must be made using the payment methods offered at checkout.
7.2. Payment processing is handled via secure third-party payment service providers.
7.3. The Order will generally not be processed until payment is received/confirmed.

8) Delivery
8.1. Delivery times shown are estimates only, unless explicitly stated as binding.
8.2. Risk of loss or damage passes to you upon delivery (or upon delivery to your designated delivery address/recipient), unless mandatory consumer law provides otherwise.
8.3. You must check the parcel upon receipt and notify us of any apparent damage or missing items as soon as possible and preferably within 48 hours.

9) Right of withdrawal (consumer information)
This section applies only if you qualify as a “consumer” under applicable law (i.e., you purchase for purposes outside your trade/business/profession). If you are purchasing as a professional/business, withdrawal rights may not apply.

9.1. Withdrawal period: You have the right to withdraw from the contract within 14 days without giving any reason, starting from the day you (or a third party indicated by you) receive the Products.
9.2. How to exercise withdrawal: You must inform us of your decision to withdraw by a clear statement sent to info@serenea-cosmetics.com. You may use a standard withdrawal form (we can add one if you want).
9.3. Return conditions: Returned Products must be unused and in their original packaging where possible.
9.4. Hygiene/Seal exception: For hygiene and health protection reasons, the right of withdrawal may be excluded for sealed goods which are not suitable for return if they become unsealed after delivery (common for cosmetics), to the extent permitted by applicable law.
9.5. Refund: If withdrawal is valid, we will refund the price paid for the returned Products and (where required by law) the standard delivery costs, within 14 days after we are informed of your decision, and after receipt of the returned goods (or proof of return).
9.6. Return shipping costs: Unless mandatory law provides otherwise, you bear the direct cost of returning the Products.

(Note: Because you sell cosmetics, the “sealed goods/hygiene” exception is important. Tell me if your products are sealed; I can tighten this clause accordingly.)

10) Conformity, defects and complaints
10.1. If you believe a Product is defective or incorrect, contact us at info@serenea-cosmetics.com with your order number and photos where possible.
10.2. Mandatory legal warranty rights remain unaffected.
10.3. We may offer, as appropriate: replacement, repair, refund, or another solution in accordance with applicable law.

11) Use of the Website
11.1. You agree not to misuse the Website, including attempting unauthorised access, introducing malware, scraping/harvesting data, or interfering with the Website’s operation.
11.2. We may suspend access to the Website (temporarily or permanently) if we reasonably believe you breach these Terms.

12) Intellectual property
All Website content (texts, images, logos, product names, graphics, layout, etc.) is owned by or licensed to the Company and protected by intellectual property laws. Any reproduction, distribution, modification or commercial use without prior written permission is prohibited.

13) Liability
13.1. Nothing in these Terms excludes or limits liability where it would be unlawful to do so (e.g., for fraud, wilful misconduct, gross negligence, or mandatory consumer rights).
13.2. To the maximum extent permitted by law, the Company is not liable for indirect, incidental or consequential damages, loss of profit, loss of revenue, or loss of data.
13.3. Our total liability in connection with any Order is limited to the amount you paid for the specific Products giving rise to the claim, unless mandatory law provides otherwise.

14) Force majeure
We are not liable for delays or failure to perform caused by events outside our reasonable control (including but not limited to strikes, transport disruptions, supply chain issues, acts of government, power outages, and network failures). Performance will be suspended for the duration of the event.

15) Privacy
Personal data is processed in accordance with our Privacy Policy on www.serenea-cosmetics.com.

16) Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on the Website with a new “Last updated” date. Changes will not affect Orders already accepted, unless required by law.

17) Governing law and jurisdiction
These Terms are governed by the laws of Belgium, excluding conflict-of-law rules.
Any disputes shall fall within the jurisdiction of the competent courts of Antwerp, unless mandatory law provides otherwise (e.g., consumer jurisdiction rules).
